Newburgh landlord rules to know in 2026
A rental license comes first. Under City Code Chapter 240, owners must apply for a rental license within 30 days of buying a rental, and no unit can be rented without one. Licenses renew every year, or every two years for owners the city designates as compliant landlords.
Every license needs an inspection. A license isn't issued or renewed until the city confirms the property meets code, either through a city inspection or a licensed professional engineer's certification. Fines can reach $500 a day.
Name an agent and a 24/7 maintenance contact. The application must name an agent for legal notices with a New York address and a maintenance contact within 45 miles, reachable around the clock. Integrity fills both roles for properties we manage.
Good Cause Eviction applies. The City of Newburgh opted into the state law with an exemption for units renting above 345% of HUD's Fair Market Rent, about $6,828 for a two-bedroom in Orange County. Renewal increases above Orange County's 8.38% local rent standard this year (5% plus DHCR's 3.38% inflation figure) can be challenged.
No rent stabilization, but a lead registry. An Orange County court voided Newburgh's 2023 ETPA declaration in April 2024. Newburgh is one of 25 communities in the state Lead Rental Registry, so pre-1980 buildings with two or more units must be registered and certified lead-safe.
Short-term rentals pay room tax. Hosts must register with the City Comptroller and collect the city's 5% room occupancy tax on top of Orange County's 5%. The Town of Newburgh is a separate municipality with its own rules.
This information is general and not legal advice. Rules change often; consult an attorney or the municipality for your specific situation.
