Historic multi-family homes in a Hudson Valley mill village

Wappingers Falls landlord rules to know in 2026

The village has a rental registry. Under Village Code Chapter 120 (Local Law 1 of 2009), rental units in non-owner-occupied one- and two-family houses must be registered, inspected and certified by the Building Inspector at least every 36 months. A fee is due before each inspection.

Good Cause depends on the address. Wappinger Creek splits the village between the Town of Poughkeepsie, which opted into Good Cause at 345% (about $6,828 for a two-bedroom), and the Town of Wappinger, which didn't. The village itself isn't on DHCR's list, so ask an attorney about properties on the west side.

Village short-term rentals must be hosted. Chapter 124 allows them only in part of a detached single-family home that's the owner's primary residence, with an annual permit. Unhosted rentals are banned.

Town short-term rentals need a permit. The Town of Wappinger's 2025 law requires an annual permit, a fire inspection and Dutchess County registration, and allows them only in single-family homes in certain zones.

No lead registry. Neither the village nor the town is in the state Lead Rental Registry.

State rules apply everywhere. Security deposits are capped at one month's rent, an itemized statement is due within 14 days of move-out, and late fees can't start until rent is more than five days late and are capped at $50 or 5%, whichever is less.

This information is general and not legal advice. Rules change often; consult an attorney or the municipality for your specific situation.
